Information on the processing of personal data of natural persons

ZOOKEE sro, as the controller of personal data, hereby informs you about the method and scope of personal data processing, as well as fulfills its information obligation about your rights in connection with the processing of personal data in accordance with Regulation (EU) of the European Parliament and of the Council of 27. No 2016/679, on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (hereinafter referred to as “GDPR”).

Privacy is a matter of trust and we want to assure you that your personal information is safe with us. Protecting and collecting, processing and using your personal data lawfully are very important to us and allow us to protect your privacy. We have internal systems and mechanisms in place for sufficient security in the processing of personal data.

 

What information do we collect about you?
We collect identification, contact and payment information about you

• Bank account


How did we obtain your personal data?
We obtained your personal data directly from you or from your employer, or from publicly available registers and registers, such as the portal www.justice.cz, the administrative register of economic entities, the trade register, the real estate cadastre.


Why and for what purpose do we collect your personal data?
We process your personal data, as this is necessary to fulfill the contract with you (or to take measures taken before concluding such a contract), and we also process your personal data, which is necessary for the performance of our public law obligations.
Therefore, we need and process your personal data for the purpose of contracting, purchasing, delivering services, goods, as well as performing the work and delivering it to a designated location, addressing your liability for defects, communicating with you and fulfilling your statutory obligations, in particular and accounting.
We also process your personal data for the purposes of any complaints or court proceedings.


On the basis of what legal title (reason) do we process your personal data?
a) The legal basis for the processing of personal data is the performance of a contract we have entered into with you or are about to enter into.
b) The legal basis for the processing of personal data is the fulfillment of a legal obligation, as the laws require us to archive certain documents, especially tax documents. This obligation is imposed on us in particular by Act No. 235/2004 Coll., On Value Added Tax, as amended, Act No. 586/1992 Coll., On Income Taxes, as amended, and Act No. 563 / 1991 Coll., On Accounting, as amended, and Act No. 499/2004 Coll., Act on Archiving and Records Service and on Amendments to Some Acts, as amended, Act No. 435/2004 Coll., On Employment, as amended, as well as Act No. 262/2006 Coll., the Labor Code, as amended.
c) The legal basis for the processing of personal data is, after the balance test performed, a legitimate interest. We process personal data for the distribution of advertising messages and the use of the services of the processor HEUREKA.cz, as well as for the purpose of contacting you with an offer of further cooperation, and for the settlement of the complaint procedure. We will also process personal data, even after the termination of the contractual relationship, for possible legal proceedings. You may object to this processing - for more information, see the end of this document, be sure to read it!
d) Consent may also be the legal basis for processing personal data, for example if you would like to receive business communications but have not yet been our client. You can revoke the consent at any time at the e-mail address: milan@zookee.cz, or in writing at our address above.
 

Transfer of personal data to third parties
Personal data are, for the purposes described above, transferred to and processed by third parties on the basis of contracts for the processing of personal data concluded in accordance with the Regulation and the law.


The processor, other controller or third party to whom personal data are transferred and processed by them are:
• external lawyer
• Heureka.cz
• insurance company in the event of an insured event
• Accounting office for accounting purposes
• IT engineers to ensure the smooth running of information systems
• carrier to hand over and deliver your shipment
• provider of e-shop solutions and web hosting services


Recipients of your personal data processed for the purpose of fulfilling obligations arising from legal regulations may also be financial administration bodies, inspectorates, the Czech Police, courts or other relevant authorities and state administration bodies in cases where this obligation is imposed on us by generally binding legal regulations.
We do not have a privacy officer.

 

How long will we keep your personal data?
We will process your personal data for as long as the effects of rights and obligations under the contract last.
After the termination of the contractual relationship, we will process your personal data for a period of 4 years due to legitimate interest, or one year after the expiration of the period, whichever is longer.
If the law requires us to archive your personal data for a certain period of time, such personal data will be archived and stored for a maximum period of time determined in accordance with generally binding legal regulations.


Do you have to provide us with your personal data?
Providing personal data and concluding a contract is voluntary, but we need it for concluding and fulfilling the contract. The law also obliges us to process your personal data with regard to accounting documents. If you do not provide us with personal information, we cannot conclude a contract with you.


How can you defend yourself against the processing of personal data by us?
If you do not agree with the processing of personal data by us, you have the opportunity to exercise your rights, which we will inform you about below. In particular, you have the right to object to the processing of your personal data if we process it for our legitimate interest, such as sending commercial messages, maintaining a client database, and for possible legal proceedings. We do not process personal data after an objection unless we can prove to you that our reasons for processing outweigh your reasons, or we need the data to determine, enforce or defend legal claims.


What are your rights?
Right to information

Right of access to personal data
You have the right to access personal data as well as to communicate information on whether and, if so, for what purpose we process your personal data. We will issue a confirmation of this upon your request. If you want to use this right, please contact us by e-mail: milan@zookee.cz


Right to repair
You have the right to correct inaccurate personal data concerning you without undue delay. For this purpose, we ask you to check your personal data on accounting documents, contracts, orders or in administration. In case you do not have these documents available or in case of any discrepancies, please contact us by e-mail: milan@zookee.cz. We will revise your personal data immediately.


Right to be deleted (be forgotten)
You also have the right to have your personal data deleted if:
• personal data is no longer needed
• you withdraw your consent if you have given it to us
• You object to the processing
• We process personal data illegally
• personal data must be deleted in order to fulfill a legal obligation


Right to restrict processing
We will process your personal data to a limited extent if:
• You will deny their accuracy for the time necessary to verify the accuracy
• we process them illegally, you do not want to delete them, but only restrict their use
• We do not need personal information, but you request it to determine, enforce or defend legal claims
• object to the processing until it is verified whether your or our legitimate interests outweigh the further processing of personal data.


The right to data portability and not to be subject to automated decision-making
The right to data portability means all your rights contained in Article 20 of the Regulation, in particular the right to obtain your personal data provided to us in a structured, commonly used and machine-readable format. You also have the right not to be subject to any decision based solely on automated processing.

The right to obtain information about breaches of security of your personal data

If it is likely that a breach of our security will result in a high risk to your rights and freedoms, we will notify you without undue delay. If the high risk does not materialize, we do not have to pass on the breach information to you.

You have the right to withdraw your consent to the processing of personal data processed by us on the basis of this consent at any time.

Advertising systems
Remarketing / retargeting

For the purpose of remarketing, we collect cookies stored in the visitor's browser. Their purpose is to display and customize the services provided by such a website each time you visit. Cookies are also used to analyze web traffic, advertising and marketing purposes. They are used by almost all websites and do not pose any danger to your system. If you want to check or modify the types of cookies, you can typically do so in your browser settings.

Remarketing or retargeting is provided by Google, Facebook and Seznam a.s. to show ads based on your previous visits to our site. We use remarketing data exclusively to segment visitors in order to deliver a more relevant advertising message. Segments are created based on several general patterns of visitor behavior. Commercial communications are displayed on Google Search, the Google Search Network, the Google Content Network through the Google Display Network, and the SEZNAM a.s. and on the Content Network List through the Click advertising network.

This service uses cookies to perform analyzes of user activity on our website. Google uses this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage.

Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use it. The information generated by the cookie about your use of this website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Our website uses retargeting technologies from the Sklik service operated by Seznam.cz, a.s. This allows us to show visitors who have already shown an interest in our products our ads on the Display Network of Seznam.cz, a.s. You can currently opt out of targeted ads at http://www.imedia.cz.
HEUREKA.cz

We determine your satisfaction with your purchase by means of e-mail questionnaires within the program "Verified by customers", in which our e-shop is involved. We send them to you every time you buy from us, if in the sense of § 7 paragraph 3 of Act No. 480/2004 Coll. For some information society services, you will not refuse to send our business communications or revoke your previously granted consent. We use a processor, which is the operator of the Heureka.cz portal, to send questionnaires, evaluate your feedback and analyze our market position; For this purpose, we may pass on information about the purchased goods and your e-mail address. The legal title is our legitimate interest in order to increase the quality of services.

We use these services only to obtain traffic statistics for our site and to increase traffic to our site.
